Schools Terms and Conditions
1. Parties: This Agreement is made between the School, Academy or Educational Establishment (the client) and Cornwall Music Service Trust – CMST (the service provider). It is not made with any individual teacher employed by Cornwall Music Service Trust.
2. Duration: This agreement will run from the date services commence. It is subject to review and may be extended or varied by agreement between the parties.
3. Intent: The intent is to regulate dealings between the parties by setting out respective obligations relating to performance and payment for services.
4. Support: Instrumental & Vocal Tuition, Classroom & Ensemble
4.1 Group size will be determined by the teacher in partnership with the client and will depend on instrumental and educational needs.
4.2 The timing of the delivery of services will be subject to teacher availability.
4.3 Tuition and ensemble support will be available on a weekly basis throughout the academic year for 34 weeks and will include 3 performance lessons.
4.4 Classroom support will be available for the full academic year (39 weeks)
4.5 When a teacher is absent, CMST will make every effort to find a supply teacher to cover the tuition or replacement lessons will be delivered before the end of the academic year.
4.6 If delivery cannot take place due to circumstances beyond the teachers’ control and a notice period of 48 hours has not been given this delivery will be billed. Where possible the teacher will endeavour to reschedule.
5. CMST Responsibilities: Quality Assurance:
Response to urgent enquiries to CMST office will normally be within three working days. All non-urgent enquiries will receive a response within one week.
6. School (Client) Responsibilities: Schools must ensure that the teaching location and conditions are suitable for delivery of music lessons.
6.1 The school has a joint responsibility with CMST for the organisation of lessons and pupil attendance.
7. Charges:
7.1 Charges will be subject to review on an on-going basis. If charges need to be changed a terms’ notice will be given.
7.2 Schools will be notified of any changes to the rates for the next academic year at the end of March. Rates from September 2018 are £42 per hour (or equivalent).
7.3 For instrumental and vocal provision there are various options available to schools and parents/carers as per our charge list
8: Charging and Payment Procedures:
8.1 Schools will be charged at the latest at the start of term for that term’s provision.
8.2 All individual and group lessons will be charged termly in advance, with a one term notice period with notice to be given no later than the final week of the preceding term in writing to CMST office. Thus lessons will only be given if they have been paid for.
8.3 Once the initial upfront payment has been made there will be a facility to pay by Standing Order, (electronic payments will be the preferred method).
8.4 Any queries relating to the calculation of charges should be directed to the CMST office.
9: Queries, Concerns and Complaints Procedure:
9.1 Any queries, concerns or complaints arising during the course of this agreement should in the first instance be made to the Head of Cornwall Music Service Trust.

Adult Learners, and Parents’ Terms and Conditions
Terms & Conditions
- Parties: This Agreement is made between the parent/carer/guardian of the learner (the client) or adult learner and Cornwall Music Service Trust – CMST (the service provider). It is not made with any individual teacher employed by Cornwall Music Service Trust.
- Duration: This agreement will run from the date of your application. It is subject to review and may be extended or varied by agreement between the parties.
- Intent: The intent is to regulate dealings between the parties by setting out respective obligations relating to performance and payment for services.
- Support: Instrumental & Vocal Tuition, Classroom & Ensemble
4.1 The timing of the delivery of services will be subject to teacher availability.
4.2 For students subscribing to MusicEL “Premium” and “Premium Plus” services, tuition and ensemble support will be available on a weekly basis throughout the academic year for 34 weeks. Live online seminar or one-to-one lessons will be delivered during school term-times unless otherwise agreed between parents/adult learners and the teacher.
4.3 When a teacher is absent, CMST will make every effort to find a supply teacher to cover the tuition or replacement lessons will be delivered before the end of your subscription period.
4.4 Commencement of lessons indicates acceptance of terms and conditions.

6. Client Responsibilities: Clients must ensure that the teaching location and conditions are suitable for delivery of music lessons. With regards to live online lessons, students should ensure that suitable clothing is worn (in the same way it would when attending a real-world lesson). The room in which the client or student is doing the live online lesson should also be as free from distractions as possible (for example, not having family frequently passing through, or washing machines on). And the room should be of a kind that you would invite a teacher into (i.e., a public-facing room such as a lounge or study, rather than a private room such as a bedroom). Accommodations can be made to ensure students/clients are able to engage in lessons within the constraints of the spaces available to them. However in order to maintain safeguarding, and the professionalism of the services offered, any accommodations will be by agreement with the teacher.
6.1 The client takes responsibility for ensuring the learner attends timetabled lessons. In respect of pupils in receipt of subsidised lessons, we reserve the right to withdraw the allocated subsidy and charge parents if more than three consecutive lessons are missed.
Charges:
7.1 Charges will be subject to review on an on-going basis. If charges need to be changed at least one month’s notice will be given before the renewal of your subscription.
7.2 Clients will be notified of any changes to the rates for subscriptions with at least one month’s notice. Clients will be able to cancel their subscriptions at any point before the next monthly payment is due to leave their account. This can be up to 3 days before the transaction date, depending on the bank you are using.
7.3 Cancelling or changing your membership. For changing your membership tier, whether you choose to upgrade or downgrade your tier, there are various options available to clients on our membership options page. Changes when upgrading will take effect immediately upon payment. Changes when downgrading will take effect at the end of your most recent monthly or yearly subscription period. Refunds are not available for part-periods. If you have signed up for 1 year’s subscription this is not refundable part-way through a year. And if you have signed up for monthly payments, this is not refundable part way through a month.
8: Charging and Payment Procedures:
8.1 Clients will be charged once they have completed the Stripe payment process.
8.2 If you have signed up for a monthly or annual subscription service, Stripe will continue to deduct the regular payments until you cancel your subscription through the MusicEL Dashboard.
